Only services purchased directly on the Local HVAC Equipment Site are eligible to file claims.

For example, if a customer buys any type of service directly from one of our service providers; they are not eligible to file a claim.

All services must be obtained through our site to qualify to make a claim.

At no time shall any customer be entitled to recover from Local HVAC Equipment more than the purchase price paid for Qualified Service.

Although frustrating, difficulty in scheduling, late start time or a service provider’s slow responsiveness are not elements of quality satisfaction. Customers dissatisfied with these performance elements are encouraged to submit a contractor review evaluating these elements for such service providers.

Dissatisfaction with pricing of Qualified Services is not an element of service quality.

Claims & Timelines

Customers must attempt to contact the service provider about addressing the service quality issue(s) and wait for at least two (2) to five (5) business days for a response.

Many service satisfaction issues arise from miscommunication of expectations; most service providers want satisfied customers and are willing to quickly address the satisfaction concern to gain repeat customers.

After 7 days Customers are eligible to make claims

Repairs

Customers must submit a Service Quality Claim after a 7-day period, but in any event no later than 30 days to file a claim for any Repairs.

A claim period for any repair must be submitted within 30 days. Any claim submitted after that period will not be processed.

Installations

Customers must submit a Service Quality Claim, after a 7-day period but in the event no later than 90 days to file a claim for Any HVAC Equipment Installation.

Claim Period for any HVAC Equipment Installations is 90 Days.

Support & Remediation

Local HVAC Equipment is here to help make caring for your home a positive, easy experience. Our intent is only to use qualified HVAC contractors; when you book and pay with us, we’ll not only back their work to ensure the job’s done right, but we’ll also help cover certain damages in the event the contractor is not responsible, subject to coverage limits and eligibility up to $2,000.

Local HVAC Equipment will process the claim and follow up with our HVAC master to ensure that any claims are resolved.

In the event of damages, you must submit claims to the designated party that was involved with the damages and try to resolve them.

In the event one of our contractors doesn't want to process a claim, we would investigate any claims and make sure that the claims are resolved with their insurance.

All our Contractor are qualified and carry insurance for their work.

Indemnification by Service Provider

YOU HEREBY AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS LOCAL HVAC EQUIPMENT AND ITS RESPECTIVE DIRECTORS, MANAGERS, OFFICERS, STOCKHOLDERS, EMPLOYEES, AGENTS, AND INSURERS (“LOCAL HVAC EQUIPMENT INDEMNITEES”) FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, ACTIONS, LOSSES, EXPENSES, DAMAGES, LIABILITIES, COSTS (INCLUDING, WITHOUT LIMITATION, INTEREST, PENALTIES AND ATTORNEYS’ FEES) AND/OR JUDGMENTS INCURRED OR SUFFERED BY ANY OF THE LOCAL HVAC EQUIPMENT INDEMNITEES THAT RESULT FROM OR ARISE OUT OF, DIRECTLY OR INDIRECTLY, (I) ANY BREACH OF ANY REPRESENTATION AND WARRANTY MADE BY YOU IN THIS AGREEMENT; (II) ANY BREACH BY YOU OF ANY COVENANT OR AGREEMENT UNDER THIS AGREEMENT; (III) THE SALE OF ANY PRODUCTS OR PROVISION OF OR FAILURE TO PERFORM SERVICES FOR ANY CUSTOMERS OF LOCAL HVAC EQUIPMENT OR ANY OTHER PERSONS; (IV) FAILURE OR REFUSAL TO HONOR ANY QUOTE MADE TO A CUSTOMER; OR (V) ANY NEGLIGENCE OR WILLFUL MISCONDUCT BY YOU.

Limitation of Liability

IN NO EVENT SHALL LOCAL HVAC EQUIPMENT BE LIABLE TO YOU FOR LOSS OF PROFITS, LOSS OF BUSINESS OPPORTUNITY, INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES OR SPECIAL LOSSES, WHETHER BASED UPON A CLAIM FOR BREACH OF WARRANTY, CONTRACT OR ANY OTHER LEGAL OR EQUITABLE CLAIM RELATING TO THIS AGREEMENT, THE RELEVANT GOODS OR SERVICES OR PERFORMANCE HEREUNDER.

Relationship of Parties

Subject to the terms of this Agreement, you shall be solely responsible for determining the manner and method by which you shall perform the Services... LOCAL HVAC EQUIPMENT IS NOT A GENERAL CONTRACTOR, PROVIDER OF SERVICES, OR MERCHANT OF RECORD AND IS ACTING SOLELY IN ITS CAPACITY AS A SYSTEM ADMINISTRATOR... LOCAL HVAC EQUIPMENT is not a general contractor or merchant of record and that you are solely responsible for compliance with all applicable laws, rules, regulations, ordinances and orders.

Governing Law and Time Limitations for Claims

The Program, the Platform, this Agreement, and your relationship with LOCAL HVAC EQUIPMENT shall be governed by the laws of the State of Maryland, notwithstanding the choice of law provisions. You agree and consent to the exclusive jurisdiction of the state or federal courts located in Prince George's County, Maryland... Any claim or cause of action must be filed within 90 days after such claim or cause of action arose.

Binding Effect

This Agreement and the rights and obligations created hereunder shall be binding upon and inure solely to the benefit of you and Local HVAC Equipment and our respective successors and permitted assigns... IF YOU DO NOT AGREE TO ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT, YOU MUST NOT USE THE PLATFORM.
